Café Togo Online Shop Terms and Conditions

The Café Togo Online Shop is the on-line store owned by Café Togo Group Limited (“we, “us”, “Café Togo” or “our”). Access to and use of the part of the Café Togo Website, www.cafetogo.ie (the “Café Togo Website”), designated by us as the Café Togo Shop is subject to registration and to the following terms and conditions. These terms and conditions set out the agreement between you and us for using and making purchases on the Café Togo Online Shop.

By registering with us you will have accepted these terms and conditions of sale, our legal notices and our privacy policy. You are advised to read these terms and conditions each time you visit the Café Togo Website as they may change from time to time without notification.

1. REGISTRATION

1.1 You are registering as a user of Café Togo Online Shop. Access is via your user name and password, which is personal to you. You must not allow your user name and password to be used by anyone else. You must also immediately notify us if a third party obtains and/or uses your user name and/or password and / or by emailing us at info@cafetogo.ie.

You can change your password at anytime by clicking the "Your Account" button at the top of this page.

1.2 Our privacy policy can be viewed by clicking the Privacy tab on the Welcome page.

2. MAKING A PURCHASE

2.1 To make a purchase, simply browse cafetogo.ie, follow the instructions in the Café Togo Online Shop and click on any items that you wish to add to your order. After you have finished your selection, please click on "confirm order" and you will be asked for certain details which you must complete. You undertake that the information that you provide to us for the purpose of making a purchase is fully complete and accurate.

2.2 There are daily cut-off times for receipt and delivery of orders which are displayed on our website from time to time. There is a 3 hour window between final cut of time for orders and delivery of your order. You can contact us if you have any queries regarding the daily cut-off time, or delivery time of your order. No new same day orders will be accepted after 10.00am. Any cancellations or amendments to an order must be made by calling the telephone number shown on the Café Togo Website before the order is dispatched. If the order has been dispatched you accept that you will be charged for the order.

2.3 Any order you make for products in Cafetogo.ie is an offer by you to purchase such products (subject to these terms and conditions), and acceptance of any order is at Café Togo’s discretion. An order is deemed to have been accepted by Café Togo only when you receive email confirmation to this effect or when the goods you order are delivered. Once we have accepted your order, there may be occasions where, for quality reasons or for other reasons beyond our control, it will not be possible to complete your order in full. All goods are subject to availability. In such cases, we will always use reasonable commercial endeavours to contact you and to ask you to amend your order. We may, substitute alternative products where we are unable to deliver your precise order to your specification.

2.4 Cafe Togo reserves the right to refuse your order for any legitimate reason, including where the bank refuses to authorise the credit or debit card payment or if we do not believe that we can complete your order.

3. PRICE AND PAYMENT

3.1 We will endeavour try to ensure that all descriptions, details, including prices, displayed on the Café Togo Online Shop are correct and up to date, but we cannot guarantee that they are. Details may be updated from time to time and are subject to change. You must ensure that, prior to placing an order, you have checked all relevant details about the items that you have selected. We cannot confirm the price of a product until your order is accepted. All products and services advertised are subject to availability.

3.2 Price and availability information is subject to change without notice. Payment may only be made by means of those credit or debit cards listed on the Café Togo Online Shop from time to time. We reserve the right to modify the list of card types that are acceptable. You may only use one card per order. We reserve the right to limit the amount of goods purchased in each transaction on our website or on each card used.

3.3 Payment will be charged against your card at the time of order. You confirm that you are legally and fully entitled to use any credit or debit card used on Café Togo Online Shop for the purpose of making the purchase and that sufficient funds are available to cover the cost of your purchases. We reserve the right to request formal documentary identification from you or verification of your right to use any credit or debit card to make a purchase on the Café Togo Online Shop.

4. DELIVERY

4.1 Products will be delivered to the delivery point nominated by you at the time of Registration or Customers may change their nominated delivery point when placing an order. Any Changes to a nominated delivery point must be made by telephone to us at least 3 hours in advance of the time that you have requested for delivery, must be formally accepted by us and a response communicated by us before a delivery can be made. You may only specify one delivery address per order. We will endeavour to deliver your order at the time you request, however delays may occur. We make deliveries on Monday through Friday from 10am to 1pm, except for public holidays.

4.2 All deliveries must be checked and signed for by a person. You understand that we will consider the delivery of products properly delivered if any person at the delivery location signs for the delivery of the products, even if that person is not you. Signature will be deemed to constitute acceptance of delivery of a complete order. You should note that we will deliver to the delivery address as specified by you on the order form, based upon the signature of any person at that address at the time of delivery. Café Togo is not liable to you for ensuring personal delivery to you. In the event that there is no person at the address to accept delivery, you will still be charged for your order.

4.3 If any part of an order is found to be missing or is rejected on delivery, then the customer must inform Café Togo immediately by calling the telephone number stated on the Café Togo website Home Page.

4.4 All delivery points nominated by you on registration must be approved in advance by Café Togo. We will endeavour to respond with our approval within two days of a Customer registering.

5. TERMS OF SUPPLY

5.1 Café Togo food is supplied strictly for direct customer use. Under no circumstances is our food to be re-sold to a third party or offered at subsidised or inflated rates to a third party.

5.2 Café Togo recommends that Customers comply with any instructions and recommendations of Café Togo in relation to the storage and use of the products (for example and without limitation, use by dates).

6. LIABILITY

6.1 Nothing in this Agreement will limit or exclude the liability of Café Togo for death or personal injury caused by its negligence, or for fraud.

6.2 Nothing in these terms and conditions shall exclude your statutory or legal rights under Irish and EU law, whether as a consumer of products or services or otherwise.

6.3 Except as is set out in Clauses 6.1 and 6.2, our liability for any losses that you suffer in connection with this Agreement is strictly limited to the purchase price of the product you purchased on the Café Togo Online Shop.

7. TERMINATION

7.1 You can withdraw your registration by emailing the helpdesk at info@cafetogo.ie. Please allow for 48 hours to register and process your request.

7.2 We reserve the right to terminate your access to cafetogo.ie immediately without notifying you in advance. We reserve the right to cancel your order at any time.

8. USE OF MATERIAL APPEARING ON THE CAFÉ TOGO WEBSITE

All rights in the site design, computer codes, text, graphics and other content, interfaces, and the selection and arrangements thereof (the "Materials") belong to Café Togo Group Limited or its licensors. You may print or download portions of this site and make copies of these for your own personal use only. Any other use (including without limitation any further reproduction, storage or transmission to anyone) of any Materials without our prior written permission is strictly prohibited.You can print a copy of these terms and conditions for future reference.

10. VARIATION

10.1 Café Togo Group Limited reserves the right to amend the terms of this Agreement from time to time. Your continued use of any part of the Café Togo Website after any such amendment will constitute your acceptance of the amendment or amendments concerned. You should therefore regularly visit these terms and conditions to ensure that you keep up to date with your rights and obligations under this Agreement. If any such amendments are considered in the reasonable opinion of Café Togo Group Limited to be material, notice of the amendments will be emailed to all registered users of cafetogo.ie at their e-mail address.

10.2 If you do not wish to accept an amendment you should immediately withdraw your registration by contacting us directly or by emailing the help desk at info@cafetogo.ie.

11. ACCESS/FORCE MAJEURE

11.1 Although we will aim to provide uninterrupted access to the Café Togo Website, we cannot guarantee this. We accept no responsibility or liability for any interruption or delay which may occur to anyone visiting or wishing to visit the Café Togo Website.

11.2 In the event we cannot fulfil obligations to you under this agreement due to any event beyond our control, we will use reasonable commercial efforts to notify you and we will be relieved of our obligations to you under these terms and conditions to the extent such performance is hindered by such an event.

12. JURISDICTION
This Agreement is governed by Irish law and both we and you agree to submit to the exclusive jurisdiction of the Irish courts. If any part of these terms and conditions is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms and conditions shall remain in effect. These terms and conditions, and the privacy policy on our website constitute the entire agreement between Cafe Togo and you for the use of our website and they supersede all other communications.

13. ALLERGY AND CONTENTS WARNING

Café Togo products may contain traces of nuts. Café Togo products containing chicken may contain bones.

Please click on the button marked "I Accept" on the Cafe Togo Website if you accept this Agreement.  Please understand that if you refuse to accept this Agreement, you will not be able to order any products from the Cafe Togo Online Shop.
